If you are an individual, by using the Website for the purposes of advertising including, but not limited to, the advertising of heavy equipment and/or the selling, buying, renting and/or leasing of heavy equipment or other heavy equipment related services (the “Services”), you represent and warrant that you are of the legal age of majority under applicable law to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website for the purposes of using our Services.
Modifications to the Terms of Use and to the Website
We reserve the right in our sole discretion to revise and update these Terms of Use from time to time. Any and all such modifications are effective immediately upon posting to this Website and apply to all access to and continued use of the Website. You agree to periodically review the Terms of Use in order to be aware of any such modifications and your continued use shall be your acceptance of the amended Terms of Use.

(e) Involve, provide, or contribute any false, inaccurate, or misleading information.

User Submissions: Grant of License

You further represent and warrant that all User Submissions comply with applicable laws and regulations and the conditions of use, User Submissions and Site Content Standards set out in these Terms of Use.
You understand and agree that you, not the Company, the Company’s parent, subsidiaries, affiliates nor their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, or successors, are responsible for any User Submissions you submit or contribute, and you are fully responsible and legally liable, including to any third party, for such content including its accuracy. We are not responsible or legally liable to any third party for the content or accuracy of any User Submissions submitted by you or any other user of the Website.
User Reviews
You may be asked to submit reviews, comments, photos or other materials (collectively, “User Reviews”) on the Website.
Your User Review, username and profile photo will be made public. Your User Review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates our Terms of Use. Users should not use reviews to coerce, incentivize or manipulate another user in an attempt to influence a review and User Reviews should not be withheld or exchanged for something of value, for example, a discount on future purchases. User Reviews may not be used for the purpose of harming competition.
User Reviews are not verified by us for accuracy and may be incorrect or misleading.

The Company has the right, without provision of notice to:
(a) Remove or refuse to post on the Website any User Submissions for any or no reason in our sole discretion.

When you provide a payment instrument to us, you represent and warrant that you are permitted to use that payment instrument. Please note that the payment information, including name and contact information, that you submit may be used and shared with our payment processing services provider and otherwise used in accordance with our Privacy Policy.
When you make a payment, you authorize us (and/or our designated payment processor) to charge the full amount to the payment instrument you designate for the transaction. You also authorize us to collect and store information regarding that payment instrument and other related transaction information.
If you pay by credit or debit card, we may obtain a pre-approval from the issuer of the card. If you cancel a transaction before completion, this pre-approval may result in those funds not being immediately available to you.
We may contact you via email in connection with a problem with your payment. If we are unable to successfully charge payment to the instrument or account, we reserve the right to restrict, or suspend access to, or terminate your account. Further, you agree to reimburse us for any collection costs and interest for any overdue amounts.
We may reject or cancel any transaction for any reason, including without limitation if we believe the transaction violates these Terms of Use, or if we believe doing so may prevent financial loss. If we do so after payment has been processed, we will issue a refund to you in the amount of the purchase price.
In order to prevent financial loss to you or to us or any violation of applicable law, we may contact the issuer of your payment instrument, law enforcement, or affected third parties and share details of any payments of which you are associated.
The Company reserves the right to change the Fees from time-to-time, and will provide you with reasonable, advanced notice prior to any changes to the Fees. If you do not agree with the Fees, you must not access or use the Website.
